Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Stay & Save platform, including the website at stayandsave.app and any related services (collectively, the "Service"). The Service is operated by Stay & Save ("we", "us", "our"), based in Ontario, Canada.

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Stay & Save does

Stay & Save is a directory and coupon-book service that lets short-term rental hosts create digital guest guides and lets local businesses list offers that guests can redeem in person. We provide the technology; we do not sell the goods or services offered by listed businesses, and we are not a party to any transaction between guests and businesses.

2. Accounts

You must be at least 18 years old to create a business or host account. You are responsible for keeping your login credentials secure and for all activity on your account. Notify us promptly at support@stayandsave.app if you suspect unauthorized use.

3. Subscriptions and billing

Paid plans are billed in advance on a monthly or yearly basis in Canadian dollars (CAD) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Applicable taxes (including HST/GST) are calculated automatically at checkout based on your billing location. Prices may change with at least 30 days' notice; changes take effect at your next renewal.

You may cancel at any time from your dashboard or the billing portal. Cancellation stops future renewals; your listing remains active until the end of the current billing period, after which it is hidden from public view.

4. Acceptable use

You agree not to:

• Post false, misleading, illegal, or infringing content;
• List offers you cannot legally honour;
• Attempt to bypass rate limits, redemption codes, or security controls;
• Scrape, resell, or redistribute the Service without written permission;
• Use the Service to send spam or to harass guests, hosts, or other businesses.

We may suspend or terminate accounts that violate these rules.

5. Content you post

You retain ownership of the content you upload (business info, coupons, host notes, images). You grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content solely to operate and promote the Service. You represent that you have the rights to the content you post.

6. Business listings and offers

You are solely responsible for the accuracy of your listings and for honouring any coupons or offers you publish. Redemption codes are issued to guests by Stay & Save, but the underlying transaction is between you and the guest. Stay & Save is not liable for disputes arising from goods or services provided by listed businesses.

7. Payments and disputes

Payments are processed by Stripe under Stripe's own terms. We do not store your full card details. Chargebacks or payment disputes may result in immediate suspension of your account pending resolution.

8. Refunds

Refunds are handled under our Refund Policy.

9. Termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continued operation would create risk for other users. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, indemnity, governing law) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any content is accurate.

11. Limitation of liability

To the maximum extent permitted by law, Stay & Save's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

12. Indemnity

You agree to indemnify and hold harmless Stay & Save from any claim, loss, or expense (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising from the Service.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here and, where practical, communicated by email. Continued use of the Service after changes take effect constitutes acceptance.
